- Introduction
The offer and sale of products on our website www.j-e.com are governed by these General Terms of Sale. Products purchased on www.j-e.com are sold by JE s.r.l. (hereinafter the Seller) with registered office at Via Giuseppe Mercalli, 13 – 00197 – Rome (RM) VAT No. 11040351006.
The website www.j-e.com allows you to browse, preview, stream, purchase and use a range of digital music content and music-related content (such as music files, music video files, previews, clips, artist information, user reviews, professional third-party music reviews) and other digital content. Digital music content may be owned by JE s.r.l. or its partners and third-party licensors and may contain watermarks or other embedded data. For clarity.
- Acceptance of terms of sale
2.1. The contract entered into between the Seller and the Customer shall be deemed concluded upon “acceptance, even partial, of the” order by the Seller, who reserves the right, at its sole discretion, to accept the “order.” Acceptance is deemed tacit, unless otherwise communicated to the Customer by any means.
2.2. By placing an order in the various methods provided, the Customer declares to have read all the information provided during the purchase procedure and to fully accept the general and payment conditions set out below.
2.3. Once the online purchase procedure is completed, the Customer must print or save an electronic copy and, in any case, keep these general terms of sale, in compliance with the provisions of articles 3 and 4 of Legislative Decree no. 185/1999 on distance selling.
2.4. Any right of the Customer to compensation for damages or indemnification is excluded, as well as any contractual or non-contractual liability for direct or indirect damages to persons and/or property, caused by the non-acceptance, even partial, of an order.
- Prices
3.1. The selling prices of the products shown on www.j-e.com are expressed in Euros inclusive of VAT and any other tax for sales “within the” European Union.
3.2. The prices of individual Products, indicated on the Site from time to time, cancel and replace the previous ones.
3.3. The prices applied are those indicated on the Site at the time of the purchase order by the Customer.
3.4. Delivery costs are indicated at the time of purchase
- Purchase methods
4.1. To conclude the purchase contract for one or more products on www.j-e.com, the Customer must fill out the order form in electronic format and transmit it to the Seller electronically, following the relevant instructions.
4.2. The order form contains a reference to the General Terms of Sale, and a summary of information on the essential characteristics of each product ordered and its price (inclusive of all applicable taxes or duties), the payment methods that the Customer may use to purchase each product, the delivery methods for purchased products, shipping and delivery costs, a reference to the conditions for “exercising the” right of withdrawal and the methods and times for returning purchased products.
4.3. The contract is concluded when the Seller receives, electronically, the reply email at info@j-e.com, after verifying the correctness of the data relating to the order.
4.4. Before proceeding with the purchase of products, through transmission of the order form, the Customer will be asked to carefully read the General Terms of Sale and the Information on the right of withdrawal, to print a copy using the print command and to store or reproduce a copy for personal use.
4.5. The order form will be archived in the Seller’s database for the time necessary to fulfill orders and in any case within the legal terms. The Customer can access their order form by consulting the “My account” section.
4.6. Before proceeding with the transmission of the order form, the Customer will also be required to identify and correct any data entry errors.
4.7. The language available for concluding the contract with the Seller is Italian.
4.8. Once the contract is concluded, the Seller will take charge of the “purchase” order.
4.9. The Seller may not process purchase orders that do not provide sufficient guarantees of solvency or that are incomplete or incorrect or in case of product unavailability. In these cases, the Seller will inform the Customer by email that the contract is not concluded and that the Seller has not followed up on the purchase order, specifying the reasons.
4.10. If the products presented on www.j-e.com are no longer available or for sale at the time of the “Customer’s last access to the site, or the” sending of the “order form, the Seller will take care to communicate to the Customer, promptly and in any case within thirty (30) days from the day following the one on which the” order was transmitted to the Seller, “any unavailability of the ordered products. In case of forwarding the” order form and payment of the price, the Seller will refund the Customer for any amount already paid in advance.
4.11. By electronically transmitting the order form, the Customer unconditionally accepts and undertakes to observe these General Terms of Sale in relations with the Seller. If the Customer does not agree with some of the terms set out in the General Terms of Sale, they are invited not to submit the order form for purchasing products on www.j-e.com.
4.12. By transmitting the order form, the Customer confirms that they know and accept the General Terms of Sale and the additional information contained in www.j-e.com, including those referenced through links, including the General Terms of Use and the Privacy Policy and the Information on the right of withdrawal.
4.13. Once the contract is concluded, the Seller will send the Customer by email a receipt of the “purchase” order, containing a summary of the information already contained in the “order form (information relating to the essential characteristics of the product and” detailed indication of the price, payment methods and delivery costs).
- Payments
For payment of products and related shipping and delivery costs, the Customer may follow one of the methods indicated in the order form.
Payments through PayPal and Credit Card are accepted.
In case of payment by credit card, financial information (for example, the credit/debit card number or its expiration date) will be forwarded, via encrypted protocol, to PayPal and/or to the Bank holding the account, which provides the related remote electronic payment services, without third parties being able to access it in any way.
Such information, moreover, will never be used by the Seller except to complete procedures relating to the purchase and to issue related refunds in case of any product returns, following exercise of the right of withdrawal, or when it becomes necessary to prevent or report to law enforcement the commission of fraud on www.j-e.com.
- Right of withdrawal
6.1. The Customer has the right to withdraw from the contract concluded with JE s.r.l., without any penalty and without specifying the reason, within ten (10) working days, starting from the day of receipt of the products purchased on www.j-e.com. However, it is not possible to exchange the chosen product for another.
6.2. To withdraw from the contract, the Customer must use and send to the address info@j-e.com the “Return Form”, an email so named in the subject line that contains the customer’s data, the date, the tax document data, attached to the order and the code and title to be returned. The Customer will receive a confirmation email within 48 hours from the Seller.
6.3. The customer must return the products to JE s.r.l. by delivering them to the courier for shipping within ten (10) working days from when they received the products.
6.4. The costs borne by the Customer are those for returning the purchased products.
6.5. The Right of Withdrawal – in addition to compliance with the terms and methods described in the previous points 6.1, 6.2, 6.3 and 6.4 – is deemed to be exercised correctly if the following conditions are also fully respected:
- a) the Return Form must be correctly completed and transmitted to the Seller within ten (10) working days from receipt of the products according to the methods described in paragraph 7;
- b) the products must not have been used, damaged or deteriorated;
- c) Before refunding, the Seller reserves the right to check and evaluate at its sole discretion that the condition of the product is unaltered;
- d) the products must be returned in their packaging;
- e) returned products must be sent to the Seller in a single shipment. The Seller, in fact, reserves the right not to accept products from the same order, returned and shipped at different times;
- f) returned products must be delivered to the shipper within ten (10) working days from the date on which the Customer received the products.
6.6. If the Right of Withdrawal is exercised following the methods and terms indicated in this paragraph 6, the Seller will refund any amounts already collected for the purchase of products (excluding shipping costs) according to the methods and terms provided.
6.7. The amounts will be refunded to the Customer in the shortest possible time and, in any case, within thirty (30) days from the date on which the Seller became aware of the exercise of the right of withdrawal. The Seller will activate the refund procedures, once the correct execution of the terms and conditions indicated above has been verified, as indicated in paragraph 7.
6.8. If the methods and terms for exercising the right of withdrawal are not respected, as specified in this paragraph, the Customer will not be entitled to a refund of the amounts already paid to the Seller; however, they may recover, at their own expense for delivery, the products in the condition in which they were returned to the Seller. Otherwise, the Seller may retain the products, in addition to the amounts already paid for their purchase.
6.9 Cancellation of a digital music purchase; refunds. JE s.r.l. grants the “user the right to cancel any purchase of a Music Product and obtain a refund within seven working days from the day after the Music Product becomes available for download. Once a Music Product has been downloaded, the” user no longer has the right to cancel the “purchase of that Product, unless it is defective. Following the refund arrangement by JE s.r.l., the” user will no longer have the right to access the affected Music Product.
- Refund terms and methods
7.1. After the return of products, using the return form, the Seller carries out the necessary checks relating to their compliance with the conditions and terms indicated in paragraph 6. In the event that the checks conclude positively, the Seller will send the Customer, via email, the related confirmation of acceptance of the products thus returned.
7.2. Whatever the payment method used by the Customer, the refund is activated by the Seller in the shortest possible time and in any case within thirty (30) days from the date on which the Seller became aware of the exercise of the right of withdrawal after verification of the correct execution of the right of withdrawal and acceptance of the returned products.
7.3. If there is no correspondence between the recipient of the products indicated in the order form and the person who made the payment of the amounts due for their purchase, the refund of the amounts, in case of exercise of the right of withdrawal, will be executed by the Seller, in any case, to the person who made the payment.
7.4. The Customer may, through the courier of their choice and attaching the invoice to the package containing the products, return the products to the Seller.
7.5. For the return of products, the Customer will bear the shipping costs, including responsibility in case of loss or damage to the products.
- Product shipping and delivery
8.1. The cost of shipping products is calculated based on the destination country and the weight of the order.
8.2. During purchase, the total shipping cost based on the selected items will be displayed.
8.3. Shipping is via Traceable Express Courier. For shipments to Italy, the maximum delivery time is 5 working days from delivery of the goods to the courier. For shipments to other countries, the maximum delivery time is 15 working days from delivery of the goods to the courier.
8.4. The shipping times indicated in point 8.3 are considered for products indicated as “”ready for delivery””.
8.5 The courier’s delivery hours are Monday to Friday from 9:00 AM to 5:00 PM. Orders received on Saturday and Sunday will be processed the following Monday; orders received during holidays will be fulfilled the next working day. In any case, delivery times are provided for indicative purposes only and are therefore not binding.
8.6 The courier is responsible for delivery. JE s.r.l. undertakes to collect any reports of non-delivery or delayed delivery of products through Customer Service and, if necessary, to assist the Customer in protecting their rights as required by law.
8.7 The assigned courier will make one delivery attempt during the day, and if no one is found at home, they will leave a notice of failed delivery that will contain a telephone number to contact.
8.8 For shipments to the territory of San Marino and Vatican City, the recipient of the goods is responsible for paying the taxes and customs duties provided for by the regulations in force in the destination territory of the products.
When purchasing Music Products, the user may be given the opportunity to share all or part of the Music Products on their social network profiles, as determined by JE s.r.l. at its sole discretion (“Social Recommendation”). The user’s use of Social Recommendations will be subject to the Terms and any other terms and conditions in effect for the social networks or online destinations where the user shares such Social Recommendations. JE s.r.l. may impose restrictions on the user’s Social Recommendations. JE s.r.l. may, for example, make the Music Product associated with a Social Recommendation available as a limited-duration preview rather than as a full listen.
